Even with the charitable organization designation, we would still need a permit - it does not come automatically, though it's generally not that onerous to get - and still need someone in charge of the bookkeeping.

And there may be some issues as to where the money goes, since Tom is not a charitable organization.  But I'm not 100% sure on the regulations for the discretion a 501 corporation has for spending proceeds.  It would need looking into.
